Why was he not prosecuted for soliciting?

She apparently has said publicly that is she is found dead of apparent suicide, it wasn't. Can we at least wait for the coroner?

While waiting for the Coroner let us ask the question: why was this woman the subject of a high profile prosecution?

Suicide notes are hard to get around. I've sometimes wondered if I'd have the courage to do time, and I don't think so. It astonishes me how easily many people decide so and so should "have the book thrown at them," and be put away for "a long time." I expect a day or two feels like a pretty long time when you're there. I hope whoever made the decision to prosecute her reflects on some of this.

I will never understand our judicial system and how we can make "deals" with people in order to get the "bigger fish".

It's too bad none of those retired Generals didn't s@ck someone off for a fee...maybe the nets would have done a story on it by now.

You need to get out of the Beltway KT, lest someone call you an elitist. There are 2.5 million people behind bars in this country...you don't think they're all murderers do you? Here's a clue Karen: DA/Prosecutors offices are the incubators of nascent political careers...get it? High profile case, make and example out of, tough on crime, blah, blah, blah. Out here in the real world shoplifters get prison, people get life sentences for having $10 of drugs in their pockets...and people in your circle walk. She should have gone to a DC cocktail party while she had the chance, she might have avoided this.

One question, one observation --

Is there a DC municipal court system or is everything a "federal" case?

Wonder if she offended some Regent University grad in the DOJ, who felt the need to punish.

Remember hearing some young things in a 60 Minutes (I think) story talking about how awesome it was that they were going to work in govt and change the moral tone of the country.

First, there is no case. They haven't charged Spitzer and I don't think they will. That was the Republican DoJ taking out a potential national figure.

Second, if you're gonna talk about Spitzer, Vitter's your man. Where is the salacious detail on Vitter coming from the FBI?

It's a strange and sad thing that in DC today, if you pimp girls out for a few hundred dollars an hour, you're a social leper who is drive to suicide, but if you pimp a war that costs 10 million dollars an hour, you're given a cushy job writing editorials at a prestigious newspaper.

Would that Kristol, Brooks, Gerson, Hiatt, and the rest had the sense of shame and embarrassment that this poor woman had.

I agree. It is a very interesting question and one that deserves an answer, especially considering the human wreckage that this very curious prosecution has left in its wake. Still, your post raises a different question that also requires an answer: Unlike the rest of us, reporters for Time can call the US Attorney or the relevant people at Main Justice and ask them to explain or justify their prosecutorial decisions. Why not ask them some hard questions?

I think Time should ask those questions and also send a reporter out to sniff around and see who is who and what is what. Maybe Adam Zagorian already knows the answers and could share them with us in a follow-up piece. Clearly, though, there is a story here. At a minimum, there should be a follow-up on the human costs involved in this case and whether justice was served in light of the lives ruined and lost.

The motivations of the prosecutors should be explored---perhaps the defense lawyers might be a good starting place as they might have some ideas about why such a remarkable prosecution was ever brought.

Like you, I have been curious about the background and motivations behind the commitment of substantial investigative and prosecutorial resources to what is essentially a street level pimping/escort service case. Unlike you, however, I lack the resources to find out the truth.

Estimates of her sentence seemed a little harsh, and what happened to Vitter in all this, did he get a "Pass" in all this??? The DOJ impresses me as a "Do Nothing"-"Hang'm High" with no in between farce for the "Well Connected". I'd like to see the names connected with all those phone numbers she had published, to say there were only 2-3 individuals with some recognition belonging to those numbers is BS, but then the media consists of many of the "Well Connected", kinda like their own little Secret Society:-))

Mitch: I asked Adam your question, and he says the Justice Department's rationale is that they decided to prosecute because she also committed money laundering and conspiracy. The triggering event was that she was about to move money from a bank account to purchase property overseas. (Shades of Spitzer!) But Adam points out these offenses were derivative of the underlying crime of prostitution, and says, "To me, it still seems like an anomaly."

I am glad that both you and Adam asked but my very strong hunch is that the answers which were given to Adam are (at best) true but incomplete. Contrary to what most people think, the FBI and federal prosecutors don’t have such ready access to financial records. Bureaucratically, its a fairly big deal and they would not expend the time and energy to get a GJ subpoena just for a simple escort service case, where the main objective is normally just the ad in the Yellow Pages and newspaper ads. Escort services, as such, are very low priority cases in the criminal justice system.

Also, “moving money” or buying property (even if the money is probably the proceeds of criminal activity) is not per se illegal and does not constitute any form of “money laundering” so that part of the explanation is clearly not true. The fact that somebody is thinking about “moving some money” would not typically justify opening a case file. So the explanation about this being the “triggering event” strikes me as false.

More importantly, the explanation seems circular. Not to sound like a broken record, but someone had to authorize the opening of an investigation file both at the investigative agency and at the US attorney’s office. Simply hearing in a roundabout way that the owner of an escort service was planning on “moving some money” or “buying some property” would not get you anything except a lecture about priorities and, more specifically, about not wasting investigative and prosecutorial resources on a “low priority” escort service case. (This would be even more pronounced at the US attorney’s office where, on the DC side, the bosses would scream about about the murder rate and street crime. On the Federal side they have their own priorities which have never previously included either escort services or penny-ante financial crimes---if this case started there, you still have the question of why they opened a file on an escort service case or even a nothing money laundering case. They don’t do those cases just like they don’t do stolen cars that moved in “interstate commerce” unless it a major auto theft ring).

I mean, think about this like pitching a story idea to an editor. Its the same thing for cops and prosecutors. Limited time. Limited resources. Everything has to be justified. So, who opened this file and what were they supposed to be investigating?

Also, as a related aside, how would they know what she was “planning” to do in terms of moving money or buying property unless they already had an investigation running and informants very close to this woman? And, again, what were they supposed to be investigating because you can be very sure that it was neither running an escort service nor money laundering.

If I were interested in what could be a major story, I’d be looking into this case much more closely. My very strong hunch is that Adam’s sources are basically lying to him. What I can’t figure out is why. There is no reason for them to lie. But I would bet real money that they are lying. My experience is that when people lie like that, it is usually worth pushing hard to get at the truth because that kind of truth is usually something really dirty and nasty. Worth pitching to the bosses?

To me, the bigger question here is why we still have Puritan laws on the books regarding prostitution. Most people's concern regarding prostitution seems to be with abuse and exploitation of prostitutes. A number of other countries (and the state of Nevada) seem to have overcome this aspect by legalization and regulation. In the case in question, I can't see where anyone was harmed. The wives of the married customers have a legitimate complaint, but I am inclined to believe that the availability of professional services is not what made their husbands slimeballs.

(No, I do not patronize prostitutes. Even if I were not married, I'm much too cheap.)

Karen, I'm still shaking my head in amazement over how that Lurita Doan thing played out.

The argument, Robert, from the people who don't have a moral objection in principle to promiscuity, is that prostitution is inherently abusive and, in this world at this time, leads to trafficking in human beings. Kristof made this argument in the NYT recently--that legal prostitution in the Netherlands has led to women being shipped from Asia and Eastern Europe and forced to work as prostitutes.

It's hard to know how true such claims are. They obviously aren't true in this case or in Spitzer's. But even then, according to an article in Slate that I'm not going to try to find right now, high priced "escorts" are frequently physically abused by their customers.

I happen to agree with you. But that's the argument that seems to carry the most weight if you don't object on moral grounds.

Again, I'm hardly an expert on the subject, but one might argue that there would be less abuse by clients if there were legalization and appropriate regulation. I haven't heard anything like that about the Nevada operations. One of the news programs did a segment recently in which they went into a brothel there to ask (of all things) about their political views. It seemed much like any other workplace.

Yes, Firenze, I know you are, which is why you keep sniping at me. I will re-post something that I posted on the health care thread, in trying to explain why I find this criticism so frustrating:

I know I got a lot of flack here for walking away from an earlier engagement on that whole Lurita item. But as much as I have found this experience to be--overall--a good one, what ticks me off is the suggestion that somehow I am lazy because I am not simultaneously reporting every single story that is going on in the world. Criticisms that begin along the lines: "A REAL reporter might think SUBJECT X was worth pursuing..." A reminder to you guys that the stories you love are the ones where a news organization has freed reporters to spend years digging into a single topic. That is basically the opposite of what I'm doing here. But I do think I'm doing a service. And by the way, I'm working my butt off. More than ever.

...P.S.: I WILL continue to call attention to that kind of in-depth work. I think it's great, too, and the more attention it gets, the better.

I pretty much agree with Sully. Outright prostitution prohibition should not exist. I'm also too cheap for them.

In cases of human trafficking, there is harm done, and that should be illegal. Don't criminilize one activity because of the harm another. Governments do that far too often, and it is never a good thing.

However, this crusade probably isn't worth fighting right now. There are more important things to deal with.
