Lobbyists Here, Lobbyists There, Lobbyists Everywhere

Charlie Black is a lobbyist, and he’s kind of a big deal. He runs an entire firm, BKSH & Associates, that represents companies as varied as General Motors, AT&T and the steel industry. He is hard wired to the Republican power grid, the kind of guy who is on the short list people call when they want to find out what is happening in the Bush White House, but can’t get anyone there to talk.

Black is also a senior, unpaid adviser to John McCain, which is a big deal in the current political environment because ever since the 2006 election cycle “lobbyist” has been a sort of rhetorical shorthand for “corruption.” Barack Obama, who has sworn off direct contributions from federal lobbyists, seized on this fact a few days back. “His top advisers in this campaign are lobbyists,” Obama told reporters on Saturday about McCain. “Many of them have been running their business on the campaign bus while they’ve been helping him.”

This quote made headlines all over the place, coming as it did not the heels of a New York Times story that described an apparent favor McCain had done in 2000 on behalf of one lobbyist, who was a friend. But no one seemed to question the veracity of Obama’s claim. In fact, the statement that “many” of McCain’s top advisers are lobbyists, or that “many of them” have been running their lobbying practice from the bus is, well, not that accurate.

There is a single lobbyist, Black, who has admitted that he has made cell phone calls to deal with private client issues from the McCain bus. But that’s it. According to the McCain campaign, there is not a single person on the McCain campaign payroll who also works as a lobbyist. The Obama campaign could not name for me another such individual.

There are, however, other former lobbyists who do work for McCain, people like Rick Davis, the campaign manager, and Mike Dennehy, the political director, as well as other current lobbyists who have unpaid roles, including fundraising for the campaign. But the same can be said for the Obama campaign. Steve Hildebrand, who is Obama’s deputy campaign manager, gave up his job as a lobbyist for Environmental Defense when he joined the Obama campaign. Buffy Wicks, Obama’s western field director, is a former lobbyist for the United Food and Commercial Workers Union.

Obama also has a number of high-profile supporters and unpaid advisers who continue to do the work of lobbyists, though there is no evidence they make cell phone calls from Obama’s bus. Former South Dakota Sen. Tom Daschle, an unpaid adviser to Obama, works as a “special” public policy adviser at the lobbying firm Alston & Bird, though Daschle has not yet officially registered as a lobbyist, in part because he just recently left the Senate. Former South Carolina Gov. Jim Hodges, a national co-chairman of the Obama campaign, oversees a firm, The Hodges Consulting Group, that is registered to lobby. Other lobbyists help raise money for Obama, but they do not contribute themselves.

So to recap: Both campaigns employ former lobbyists. Both campaigns have unpaid advisers who work in the lobbying business. Both campaigns have lobbyists who help raise money. Obama is distinguished by disallowing lobbyists from giving his campaign money directly. McCain is distinguished by having a senior unpaid lobbyist adviser, someone who has made private client calls from the campaign bus.

Both campaigns say they think they can win a debate on lobbyists. “I would dare say there are just as many lobbyists in the Barack Obama camp as there are in ours,” said McCain’s manager, Davis, in a conference call with reporters on Tuesday. “We’re happy to debate ethical standards and commitment to reform and ethics all day long.” The Obama campaign promptly replied. “Barack Obama has done more to curb the influence of special interests and lobbying than any candidate in the race,” wrote spokeswoman Jen Psaki, in an email Tuesday. “As president he will usher in some of the most aggressive ethics reforms to the White House in history.”

That, of course, begs a different question: Who will be a better money-in-politics reformer in office? It’s a healthy debate to have, one I will discuss in a later blog post. Suffice it to say, if Obama and McCain get the nominations, there will be two candidates with clear records of fighting to limit the power of lobbyists in Washington. Hopefully, the debate they have will be a bit more straightforward than Obama’s misleading claim over the weekend.

You're developing a man crush on McCain. You said two things that aren't quite right.

1) The issue is not that since 2006 the word "lobbyist" has been a synonymn for corruption. The issue is that McCain has always held himself out as a reformer who is not in the thrall of the lobbyist class. The NYT story demonstrated that this is not true. Black's involvement is further evidence.

2) You said that the Times story says that McCain did favors for a lobbyist who "Was a friend." The Times story says rather more than that.

So the question is has McCain's campaign received direct contributions from lobbyists? Then, if so, how much, and who? And would he be willing to not accept such direct contributions.

neither will be a particularly effective money in politics reformer. The presidency isn't a venue for doing anything about that. When a president is corrupt, as this one is, the forces are too diffuse to do anything about. And when the president is not corrupt, he can't do anything about what happens in Congress, which is where all the not diffuse corruption is.

There are one-off events, like pardoning Marc Rich, but the president doesn't get lobbied for much else.

Which is more likely to serve American citizens' interests? The guy with the lobbyists from large corporations or from Environmental Defense and labor unions?

That doesn't seem like a difficult question. We've seen what crony capitalism is all about. It's one reason why McCain can't win. Crony capitalism is a disastrous way to run a country, as we've seen demonstrated very clearly.

This is true. According to the Washington Post on Friday:

Michael Scherer is wrong to whitewash the record and ignore lobbyists in key positions running John McCain's campaign simply because they're being paid directly by their lobbying firms rather than directly by the campaign. His top advisers ARE currently lobbyists.

Michael Scherer reports that the lobbyists essentially running John McCain's campaign are not being paid by John McCain. Those lobbyists are being paid by their own lobbying firms.
Unless they have mastered the art of never sleeping, many of them would have to do their business on the bus while they've been helping him. I refuse to believe that John McCain's campaign is run by the undead. Therefore, I believe Barack Obama's campaign.

To sum up, John McCain lied about his closeness with lobbyists, but that should be ignored because he is JOHN MCCAIN!!!!

Please, please can we do this without the obligatory he said-she said faux-objectivity? You know, can it be the opposite of, say, the "debate" about evolutionary theory?

I'm not asking you to drag McCain's name through the mud. I'm just asking you to suspend any equivalence requirements, and let the facts say what they say.

The worst thing for your credibility on this is if you were perceived to take the goal of "even-handedness" far more seriously than the goal of simply laying out what has happened, and what we can reasonably expect based on that complete record.

Let's do this. If it's a win for McCain, so be it. He thinks that the Iraq war was a good idea. Since about 60 percent of the American people (trending upwards) currently disagree with him on that point, we'll just move on to that little problem with his candidacy, if the Senator from Arizona can be expected to contribute as much or more than the Senator from Illinois to the money-in-politics reform movement in this country.

As Obama has said, real change comes about from the bottom up. Only when the public is informed of the outragious ties between politicians and lobbyists will change begin. Right now, I would suppose that many readers of Time just think Abramoff was some sort of rogue lobbyist. He was not. He was a Republican Party insider.

Even a fawning press will not stop normal people from seeing the absolute hypocrisy of this. McCain has based his entire career on telling us how honest he is, after that Keating thing was out of the way. He has lobbyists running his campaign. The special interests are responsible for representing his values to the people, the people he keeps bellowing his disapproval of lobbyists to.

The press can go on looking for the mid-point equilibrium on this, but regular folks are not quite as blind.

That "on the campaign payroll" caveat is a big one. Black is getting paid by his lobbying firm, and working for free for McCain. The McCain campaign had loads of cash trouble a while back-- is Black the only who fits that description?
Another important caveat from that same sentence: "According to the McCain campaign." I don't need to link to Stephen Colbert's speech from a few years ago to point out the problem with that one.

As for the Obama folks you mention, a guy who had been "a lobbyist for Environmental Defense" sounds like he's not as open to the charge that he's planning to cash in, though there might be other factors there that I'm not aware of. And every campaign has loads of pols who are "unpaid advisers," so Daschle's title doesn't mean much. Hodges, there might be something to that one.

I think that is the big one here. High-ranking McCain staffers are still working as lobbyists right now. "Schmidt and McKinnon said they remain with their firms, but are not lobbyists and have recused themselves from the issues of their clients in the McCain campaign. 'I've never discussed a client issue with the candidate or his staff,' McKinnon said in an e-mail." Well, that hardly means their role in the GOP candidate's campaign is completely valueless to their clients.

In short, you may well be right to call this a tie between the two campaigns, but I'm not yet convinced.

As usual the bigger point is being missed here.

Let's take the personal qualities and records, which we can argue ad infinitum, and just see who each candidate is beholden to.

When everybody was writing off John McCain this summer , his precious few dollars were coming from lobbysist. Bottom line: he owes them.

Obama has some lobbysist involved in his campaign, to be honest, but he doesn't take money from federal lobbysist. Most importantly, his million donors, most of them small, make him far more accountable to the people than lobbysist.

With John McCain, the lobbyists are an organizing priniciple of his campaign; with Obama they are merely background noise.

Nice piece overall, Michael, but false equivalency is a form of bias as well. On this issue, Obama earns an A minus, and you give him a B. John McCain earns a C plus, and you also give him a B. Grading on a curve may make you feel good and avoid evoking the ire of one side or another, but let's not pretend, Michael, that this is, in fact, an accurate representation of the truth.

And, I think I have seen a subtle, unacknowledged shift in the perspective of at least one writer on this blog. Jay Carney, on the other hand, appears so eager kiss the right bottoms to enhance his career arc that he is the one writer here who is truly worthy of our derision. Jay, just go away.

Michael, If you've read this far, you've seen how your commenters have schooled you on the deceptive assertion that, because a lobbyist isn't on a candidate's payroll, doesn't mean there isn't a conflict. The fact that the lobbyist is unpaid is actually more damaging. It means that he is actually contributing the value of his normal hourly fee to the campaign, while still on the payroll of his corporate clients. In light of the fact that a lobbyist is someone who is paid to influence the opinions of elected officials, wouldn't you rather his paying client be the candidate, rather than those who are trying to influence the decisions of the candidate? If not, his fiduciary duty is to the corporation that pays him over the candidate for whom he volunteers.

Michael, I realize you're young and probably energetic, but consider that it's a good idea to slow down, think things through, turn an idea over in your mind for a while, before you hit the keyboard. It will help you avoid embarrassing blurts like the one above.

Sorry. Just now getting to read through my daily denunciation. I agree with those who have concerns that an unpaid lobbyist has such a central roll in the McCain campaign. It should be watched closely, and if Black ever tries to use his proximity to McCain to benefit his clients, he should be called on it.

As I said in the piece, Black's role distinguishes the McCain campaign from the Obama campaign. (Though there are unpaid lobbyists, and I do consider Daschle a lobbyist even though he is not registered, that have significant informal roles in the Obama campaign as well, they do not play as senior a role.) The main thrust of my post, however, was that Obama is being misleading on three points:

1. He seems to define lobbyists in different ways to suit his interests. Former lobbyists are not "lobbyists" when they give money to his campaign, but they are "lobbyists" when they work for McCain.

2. If Obama is making hay out of the former lobbyists who work for McCain, he makes fair game the former lobbyists who work for Obama. And there are a whole bunch.

3. Obama spoke of "many" current lobbyists who are doing their business from the McCain bus. This is false. There is one. Charlie Black.

Now all this does not end the conversation about whether or not voters should be concerned about either McCain or Obama's ties to current or former lobbyists. Nor am I making a claim that there are no differences between Obama and McCain when it comes to their relations to lobbyists. I am just trying to make sure that the debate over this sticks closer to the facts than Obama was having it over the weekend.

And yes, Diogenes, I consider myself relatively young and energetic. Though the way this campaign cycle is going, neither will be true for long.

Its not fair to point out that he is a typical politician bought by the highest bidder, 'cause 'bama has representatives of the incredibly wealthy environment and labor interests helping him out.

She was an organizer and field coordinator for the UFCW's Wake Up Wal-Mart campaign. Many organizers register as lobbyists as a formality but to call her a lobbyist is really a stretch.

And, even if she had been a lobbyist for a labor union, she would have been representing the 1.3 million grocery workers, meatpackers and other union members on Capitol Hill.

The actual point of this whole lobbyist connection is that McCain has told anyone who will listen about the "evils" of special interests and lobbyists while employing more of them (57) than any other campaign.
