Obama Files a Nevada Complaint

KT - Were you in Nevada? Seems like all of Times folks were covering the Republican proceedings in South Carolina. I don't necessarily object to that since the SC primary was a bigger deal in terms of who will eventually get the nomination but if Time had anyone on the ground in Nevada it'd be nice to hear if they have any perspective on who's telling the truth here.

You may not have seen that there were presidential candidate mail servers shut down today.

The original plan for dealiing with FISA was to resume debate on the intelligence version of the bill on Monday. The republicans had a retreat scheduled for Thursday, and there was important business to do in Davos to do over the weekend. So the plan was to resume where they'd left off on Monday.

However.

The blogosphere started getting organized. In particular, presidential candidates Obama and Clinton were being pressured to back up their stated support for Dodd's filibuster with their physical presence.

Moreover, the question of actually standing up, going to Washington and leading the nation in opposition to capitulation to corporate and corrupt republican interests kinda got in the way of the question of who was for single payer plans before he/she was against them.

This is a story that strikes to the heart of the campaign right now, and going into superduper tuesday, it needs to be covered. The debate between Obama and Clinton is about who is the most authentically progressive, or rather, Clinton's trying to blur the differences between them (if they exist).

Going to Washington, standing up and expressing opposition to violating the rule of law in the interest of telecommunication companies would break through this argument.

It would also address the dueling charges that one or the other is in the pocket of corporate interests.

So, isn't this a big story? Shouldn't the question of whether Obama and Clinton will go to the Senate and join Dodd's filibuster a big story? If Clinton's mail servers had been shut down following an identity politics exchange, wouldn't that be a big story?

Here's a horse race story, an issue story, a definition story. It will get prominent play, won't it?

Mike M and Jayack: Alas, last weekend I was in South Carolina -- where I will be returning tomorrow. We had two people in Nevada, but I am not aware of them witnessing any of this stuff. And, no, I was not aware of a mail server shutdown. I have not had any trouble sending or receiving email to and from the campaigns.

Re: the 11:30 question:

The caucus rules are semi-ambiguous, because they require that the caucus begin at 11:30, allow registration until noon, but require that viability be determined by noon.

The only way to interpret these provisions in a consistent manner is to assume that you had to be there by 11:30 -- but that everyone did not have to be officially registered until noon. Once everyone in the room was registered, viability levels could be determined -- that had to be done BEFORE noon-- and leaving the doors open until noon would make it impossible to accomplish that. In addition, at 11:30, the rules were explained -- in other words, if you arrived later than 11:30, you wouldn't know what the rules would be...but if you were in the room, waiting to be registered, you'd hear those rules.

In other words, although the rules may seem ambiguous, their intent is pretty clear in that people were supposed to be at the caucus by 11:30. (this is confirmed by the Nev. SOS website, which says "Sign-In: Arrive by 11:30 am")

Now... how about Jay Ackyroyd's point that two of the Democratic candidates running are sitting senators with on the record commitments to support Chris Dodd's fillibuster and campaign schedules that don't seem to allow for them to actually follow through? It's a story that we're all interested in. Will anyone at Time tell it? It is campaign related, as Jay says. It's also unique in that its a perfect example of where priorities should lie for a Senator who is also a candidate.

Good find, mediasux. I imagine Obama's lawyers know about the ambiguity of the rules, so what's the pay-off here? Filing an official complaint is only worth doing when you have a solid case. Otherwise, you just risk looking petty and childish. Either Obama's legal team knows something we don't or this was a serious mistake.

One of the interesting angles on a potential FISA story is the fact that Harry Reid is going to force Democrats to actually filibuster after letting all his Republican buddies get away with not doing it, all year long.

You know, on further inspection, it looks to me like the caucus itself actually begins at 12. It's at 12 that the attendees vote and viability is determined. Although caucus-goers are encouraged to be there by 11:30, they don't have to physically be in the room until 12. If it's true that the Clinton campaign encouraged or directed its supporters to shut the doors at 11:30 AM or earlier, as the complaint allegses, that's a serious breach of the rules.

Personally, I don't see how Obama's campaign can factually prove who shut the doors and when. If they do somehow manage to implicate Clinton convincingly -- and before Super Tuesday -- then this is HUGE.

the payoff is really pay-back.... for Bill's claim that he heard union reps threatening hillary supporters with lousy schedules if they did not support Obama.

It should also be noted that you really have to delve into the rules and understand them as a whole in order to conclude that you were supposed to be there by 11:30. I'd not put it past the Obama campaign to take the "register until noon" quote from the rules out of context -- they have that quote, and Hillary has a long explanation that is going to come off as 'parsing the rules' ....so guess who wins the soundbite battle?

mediasux - As per your links, the rules are ambiguous. The caucus is called to order at 11:30 am, but registration is allowed until 12 pm. Both campaigns are obviously drawing their own conclusions as to the intent of these rules, but it's certainly not clear. Denying people entry when registration is still open certainly isn't consistent with the posted rules for the caucus.

So Hill says Barack is frustrated after the debates, and then her campaign says he is frustrated about Nevada. Now is it time for reporters (aka stenographers) to write stories about Obama's "frustration?"

I wonder if BIll/Hill are aware that they might be setting themselves up to inevitably lose in November? With a fractured Dem constituency, the lingering sense of a dynastic Presidency souring the electorate, does Hill really have a chance?

the caucus begins at 11:30. The temporary chair explains the rules and reads a letter from Harry Reid, then a permanent chair is elected. Once that is completed, and BY NOON, the viability numbers are announced by the permanent chair.

Howard, the problem is that you cannot keep registration open until noon, while at the same time accomplishing what has to be done before noon. For instance, until everyone who is eligible to vote for the permanent chairman has been registered, that election can't be held. (in theory at least -- most permanent chairs are probably the same person as the temporary chair, and selected by acclamation. But if there was a close election for who got to be permanent chair, then everyone who was eligible to participate in the caucus would have to be registered first.)

And since its the permanent chair that has to determine the viability numbers by noon, the rules make no sense if you can keep the doors open until noon....

Please keep in mind that caucuses are actually party meetings, and that the presidential selection process is only part of the business of the caucus -- and in fact the fourth order of business. (after the rules are announced, a letter read, and a chair elected, only then does the selection of delegates to the county convention take place.)

Mediasux: I meant that the actual business of the caucuses begins at 12, which is probably why attendees have until then to show. From 11:30 to 12, it's mostly ceremony and orientation. Not that that isn't important -- even crucial -- but the rules are clear that you can be in the room as late as 12:00:00 PM and still be allowed to participate. If the doors are closed before then, Obama is technically right and this is a serious violation.

If the complaint sticks (which I doubt), it's pretty damning. I'm afraid the more likely outcome is that will backfire and it will look like Obama's a sore loser.

Boston... with all due respect, while the media (and the campaigns) may give the impression to people that the sole purpose of the caucuses is the presidential nominations process, that is only a part of its purpose. The actual purpose of the caucuses is local party organization, and "town hall" style direct democracy. (The noun "caucus" means "group" not "election". The verb "to caucus" means "to meet" not "to elect".)

I and thousands of others are sending emails right and left to the candidates. A particular emphasis has been placed on Edwards, because he is in the best position to call out Clinton and Obama on standing up for their constituents (without doing very much himself). The "talk vs. action" issue can go very different ways on this.

If these two don't stop campaigning for a few f---ing days to show up and support Dodd's filibuster (which Harry f---ing Reid has declared in a fit of miserable pique will be a real filibuster, and not a "silent filibuster" he reserves for the Republican minority), they will probably never have my vote. Period. Ever. F--- them. General election, whatever. I don't care any more. From then on, it will be about who I hate most, that's all.

A lot of people who call themselves Democrats feel this way. A lot of people who were burned by voting this do-nothing, roll-over Congress into power in 2006 have not forgotten. They know that all that is required of the Presidential candidates is for them to stop using the spotlight to talk about themselves for a few moments, and just show up--it's like a civil rights march without the marching part. It's literally about civil rights--every American's. It's about a government that is accountable to the electorate.

Glenn Greenwald says it best again:

If and when telecom immunity is passed (thereby forever extinguishing any hope of investigating and obtaining accountability for the President's illegal spying programs), and the Bush administration (and subsequent presidents) are vested permanently with vast new warrantless eavesdropping powers to spy on Americans, it will be because Harry Reid and the Democratic leadership conspired to ensure that it happened. They aren't just standing by meekly, failing to oppose it. They are actively enabling it with as aggressive a posture as the Republicans could possibly have employed had they still been in control of the Congress.

And that's separate and apart from the fact that telecom immunity will, in effect, end any prospect of accountability for Bush officials and telecoms who deliberately violated our laws for years in how they spied on us, and, by squelching these lawsuits, will block off the sole remaining avenue even for finding out what they actually did. It will take years, probably decades, for us to learn the real story -- once there's some Church-type Commission again or the relevant documents are declassified. Thank God those awful, Bush-enabling Republicans were defeated in 2006.

For what it's worth (not all that much), both Obama and Clinton have told Markos Moulitsas, in response to being asked, that they oppose telecom immunity and support Dodd's filibuster. Far more active efforts than that would be necessary to have an effect.

This is the moment, folks. This is when the whole sorry business gets swept away from the public view, never to be uncovered again. How can we trust that Barack Obama truly cares about our civil rights and will make government accountable to the people again, if he doesn't support a filibuster in person? What evidence would there possibly be to convince anyone that Hillary Clinton wouldn't be as secrecy-obsessed as Dick f---ing Cheney, if she doesn't do the right thing now and show up? Why wouldn't John Edwards loudly call upon the people in this campaign who have the power to stop this from happening to show up and do so, if he really cared about the people getting their day in court against powerful corporations?

This is the Mr. Smith goes to Washington moment of truth in this campaign. As jayackroyd so correctly points out:

mediasux - The problem is that since the rules weren't clear, we're reduced to trying to read into what was intended. I can understand the idea that due to logistics, it's not ideal to keep the doors open until registration is closed. But the fact that they didn't specify that only people who showed up before 11:30 could register left it open to interpretation.

So I can understand why Obama's campaign would be bothered by the fact that the Clinton campaign specifically told their people to close the doors by 11:30. I don't think they should have filed a lawsuit over it, though, because it probably won't accomplish anything other than making them look like sore losers. Dennis Kucinich should have been all over it anyway ;)

Good point. I just hope the complaint doesn't bring with it the accusation that he's a crybaby, especially if it ends up having no bearing on the current election.

I saw your post about that only after I posted myself. Coming from a primary state, there's a lot to misunderstand about the caucuses. My point was simply that Nevada obviously created the half-hour window from 11:30 to 12 for a reason, and it looks to me like that reason was not to bar people from the presidential vote even if they missed the procedures and votes that occur prior to that. Whether or not that's a good rule is up for debate, but that's a discussion for another day. If (and that's a BIG IF) Obama really can connect the dots back to Clinton, she's in trouble. Even if she didn't intend to violate the rules, it's disenfranchisement.

well, I found the kicker.... on page 53 (bottom), which describes the procedures for the "at large" caucuses (the ones on the vegas strip) it says...

Not a well written rule book. My understanding of the problem is the Clinton people also had their own book on procedure that had the "11:30 doors closed rule" but didn't have the "those in line" rule. Given all the hyperventelating by all side, tempers flared. I'm not sure what Obama thinks he gains by pursuing this. Time to move on IMO.

Do you just disagree with us about the signifigance? Or about how signifigant it should be? Or do you just not think the story has legs? Time Warner is offering digital phone service. I don't know if the NSA asked them to listen to their digital phone customers, or if that is as easy as tapping into the regular network. But, it's something the corporation as a whole would likely not want to go forward.

I suspect that since the media world and the telecommunications world are rolling up into one big package, that the major media companies are in favor of the FISA retroactive immunity just in case they are in this position themselves later.

It's why I am in favor of re-regulating the media. Most journalists are ethical. But there is so much financial conflict of interest it isn't funny.

Copyright, relaxing expansion rules into multiple markets, corporate tax breaks etc are on the line just for an "old fashioned" media company, let alone GE which has defense concerns that it's quite impressive that the media is as unbiased as they are.

Billions of dollars flow one way or another to these companies in aggregrate depending on who is in the White House or congress. Pretending that it is not an issue at all is quite naive.

Dodd just finished his statement.

Debate resumes tomorrow. They have apparently accelerated this, canceled a Republican retreat, messed with people's critical Davos schedules, to get this done as fast as possible, with as little publicity as possible.

KT, this is directly relevant to the campaign. All three democratic candidates are being urged, as strongly as possible, to support Senator Dodd and stop this.

this is especially relevant because Obama and Clinton have expressed their support for Dodd. The current conflict going on is the authenticity of their commitment to core democratic party values particularly those of committed primar voters. The FISA bill is right at the centerpoint of those views. Either candidate who is currently in the Senate, or the struggling outsider, Edwards, has an opportunity to demonstrate their commitment to the principles they say they espouse.

the back and forth on health care--about who really supports single payer, even though neither do now--is dwarfed by this question. They say they support Dodd. Is this just talk, or not? If they show up, they garner support. This is a huge issue going into super duper tuesday.

Unless, of course, none of them do anything.

Obama's in trouble, and he's looking for a way to regain some initiative. I really don't see much of a downside here, as the story won't get any play unless the charges gain traction. If they don't, the whole thing goes away, with no cost to Obama.

As for the people asking about why Time isn't covering FISA, imagine what public opinion would be if people actually knew something about the issue, knew exactly what Dodd was fighting against and why. Can't have that. Besides, Romney is stiff! Hillary is calculating and has cleavage! And John McCain is the wonderfullest, most kind, decent, honest human being anyone has ever known. And he's linearly loquacious!

KT if you have a chance can you ask Obama if he thinks Harry Reid should resign, for giving Bush a blank check, the Republican Senate a free ride, and for ignoring the Democratic Party, that he is now forcing to filibuster?

Have you ever been to a caucus? I believe Nevada was following the general Iowa caucus rules.

In Iowa, the caucus starts at 6:30 but not really - it is just people signing in and getting with their group, no actual caucus activities. You have to be there by 7:00 or you can't get in. It starts at 7:00.

In Nevada all people up to 12:00 should have been allowed in - the real caucus starts at that time.

I've done it a couple of times. The Clinton rule book was WRONG! Stop making excuses.

Check which section that is in. I don't know if the hillary manual the obama campaign has only applied to the at-large sites or if the Obama campaign has complaints about them closing the doors early at the non-at-large sites or not.

I was there and witnessed the following: An elderly woman walking with a cane came and sat beside me. She was VERY upset! She had on an 'Obama' sticker. When she went to sit in the area designated for her district, she was told if she did, her 'Obama' vote would be counted as a vote for Clinton.

ABC News' Sunlen Miller and Eloise Harper report: The Obama campaign held a conference call, Sunday, rehashing the caucus day events in Nevada. They claim that the Clinton campaign encouraged their operatives to close caucus doors at 11:30 a.m., which was a half hour before the noon deadline.

Obama campaign manager David Plouffe claimed that the Clinton precinct captains were given a bound manual by the Clinton campaign that said the registration deadline was 11:30, which is contrary to the manual supplied by the Nevada Democratic Party. The Obama campaign precinct captains did not carry special Obama supplied manuals -- they only had the Nevada Democratic Party's manuals. When asked why the Obama precinct captains did not speak up if they had an official manual with contrary information from the party, Plouffe demurred, and said that, because of the rushed times on caucus day, tensions were high.

The Obama campaign "claims" that they are not calling the final results of the caucus into question, rather, they are making sure this does not happen again. But their second conference call in two days on this matter, after an official campaign statement last night, clearly shows they are trying to at least cast doubt on Clinton's win.

The campaign will notify the Nevada Democratic Party, for a full review of this, to provide a full picture, and to collect relevant facts. The campaign has provided a page from the Nevada Democratic Party's manual, as well as the page from the Clinton manual, specifically discussing when door times close.

The Clinton camp rejects these claims, saying that they don't have the authority to close the doors, and called Obama's accusations bogus. The Clinton camp is sticking by their assertions of voter intimidation -- and have filed complaints with the state party.

I live in Las Vegas. The phone lines were clogged on KNPR the night of the caucus with callers describing what happened to them. The call-ins were featured during the week. I can't tell you how many stories I listened to describing Clinton campaign workers insisting on recounts when the votes didn't go their way, grabbing the ballots, and calling the new count in when the subsequent vote count changed in Clinton's favor.

If Obama didn't complain, if he didn't honor the complaints he's getting, he would be reviled here.

The lines outside some of the schools and libraries were so long by 11 AM that getting those people inside in time was in jeopardy. There were more than one account of Clinton campaign workers sending voters away, telling them to go to other precincts.

114,000 people came out for this caucus, for the Dems alone. No one anticipated this response.

KRE... there are distinct differences between Iowa and Nevada rule. For instance, In Iowa, after the first separation into candidate groups, everyone can still move to another group. In Nevada, after the first separation into groups, if you are in a group for a viable candidate, you have to stay there -- only those in non-viable groups can move to another group.
